China entwickelt sich immer schneller zu einem globalen Innovationszentrum. Dies lässt sich an verschiedenen Indikatoren ablesen. So hat das Land im Jahr 2008 rund 457 Milliarden Renminbi für Forschung & Entwicklung ausgegeben, das entspricht einem Wachstum von 23,2 Prozent gegenüber dem Vorjahr 2007. Die Zahl der Forschungszentren nimmt ständig zu, und die chinesischen Patentanmeldungen gehen steil nach oben.

If a Patent application concerns a new biological material which is not available to the public, and which can not be described in the statutory way, the applicant shall deposit a sample of biological material before or on the date of filling (Rule 25 of the Implementing Regulation of Patent Law). In dem neuen chinesischen Patentgesetz 2009 wird gesetzlicher Schadensersatz erheblich erhöht; die vorgerichtlichen einstweiligen Maßnahmen werden verstärkt. Für ausländische Firmen sind die Änderungen von Verjährungsfrist besonders zu beachten.

China wird das neue Patentgesetz in 2009 erlassen. Die wichtigen Änderungen rechtzeitig zu kennen und dann IP Strategie anzupassen, ist für ausländische Unternehmen in China sehr wichtig. Änderungen im letzten offiziellen Entwurf, die den ausländischen Firmen von Bedeutung sind, werden hier kurz dargestellt.
